THE SLEEP RETREAT TERMS AND CONDITIONS
Your contract is with Sleep Works Consulting
Your contract will incorporate The Sleep Retreat Terms and Conditions (“Terms and Conditions”). It is therefore important that you read carefully the following Terms and Conditions as these will form the basis of your contract. By purchasing a ticket and registering to attend The Sleep Retreat hosted by Sleep Works Consulting, you also agree to having read and understand the Privacy Policy and Terms and Conditions of the Imiloa Institute, where the retreat is located: https://imiloainstitute.com/privacy-policy-terms/
Interpretation:
1. Reference to “you”, and “your” means the persons named in the booking (including any person added or substituted subsequently.
2. “We”, “Us”, “Organizer” and “Our” means Sleep Works Consulting, the organizer of the retreat.
3. Reference to “retreat’ means the services we have agreed to provide or provide you with under your booking with us.
4. References to “Retreat Start Date” means the start date of The Sleep Retreat you have booked as stated on the payment info document that you receive via email before paying your deposit.
5. A reference to “in writing” refers to email only. The email should be sent to Sleep Works Consulting at hello@sleep-works.com.
1. Booking:
1.1. Your booking shall only be deemed to be accepted and a contract in existence, once when we have received cleared funds of deposit from you. The amount of deposit payable will be confirmed in a confirmation sent to you by email, upon receipt of your enquiry of making a booking onto the retreat.
1.2. The contract incorporates these “The Sleep Retreat Terms and Conditions” which are governed by Canadian law and the jurisdiction of the courts of Canada.
1.3. All notices and communications regarding this contract should be sent by email to hello@sleep-works.com.
1.4. We reserve the right to refuse to accept bookings in our absolute discretion without stating the reason for doing so.
1.5. We will not share your personal details provided with any third parties. This does not include the information that will be shared with The Imiloa Institute.
2. Payment:
2.1. To secure your spot for the retreat, a non-refundable deposit is required upon booking. Alternatively, you may pay the entire ticket amount at the time of booking.
2.2. If paying using a payment schedule, the remaining balance must be paid 35 days before the start of the retreat (September 30, 2024).
2.3. If using a payment schedule, amounts due and their payment deadlines will be stated on your follow up email with your booking confirmation; if the minimum payments are not made by the due dates, we reserve the right to cancel your booking and you will not be refunded any previous payments that have already been made.
2.4. Payments can be made by Interac E-transfer within Canada. If paying from an international bank (outside of Canada), you can make payment through Stripe.
2.5. I acknowledge that all payments made to Sleep Works Consulting or Imiloa Institute are non-refundable and I understand insurance is strongly recommended in order to protect my investment.
3. Travel Arrangements:
3.1. All travel arrangements to and from San Jose International Airport are your responsibility and at your own cost. We shall not be held liable for any consequences arising from flight delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel.
3.2. Private charter flight and luxury ground transportation from San Jose International Airport (SJO) to the Imiloa Institute on November 4, 2024 and return on November 9, 2024 is included in the price of The Sleep Retreat ticket. You agree to arrive at San Jose International Airport (SJO) prior to 7:00 AM on November 4, 2024. If not possible, you agree to book your arrival at SJO the day before & spend the extra night in San Jose at your own cost. You agree to book your departure flight from San Jose International Airport (SJO) after 1:00 PM on November 9, 2024.
3.3. In case of any travel delays, you agree to contact the Retreats Concierge Team at the Imiloa Institute as soon as possible so alternate arrangements can be made. You can contact the Retreats Concierge Team via email at impact@imiloainstitue.com or via telephone at 1-305–600-0906.
4. Travel Insurance:
4.1. We highly recommend that you purchase individual travel insurance for your trip. We suggest that you include “cancel for any reason” with your policy, as well as cancellation.  You must purchase travel insurance that includes medical coverage. Clients are responsible at all times for their own personal documents, baggage and equipment, whether hired or not. You should bring the policy with you in case of an emergency.
4.2. You may purchase travel insurance by visiting the following link: www.globalrescue.com/imiloa. Any questions about the travel insurance can be emailed to: memberservices@globalrescue.com for any questions about Imiloa's recommended travel, medical and “Cancel for Any Reason” insurance provider.
4.3. I understand this insurance must be purchased within 20 days of purchasing travel. If I choose not to purchase travel insurance from Global Rescue I will purchase a comparable “cancel for any reason” insurance policy of my choice to protect my investment.
4.4. I understand that chargebacks are not an acceptable way to cancel my ticket and will be contested. I also understand that a default of payment on my purchase is not an acceptable form of cancellation.
5. Your Health:
5.1. It is your responsibility to let The Sleep Retreat hosts or any facilitator at the retreat know if you have any injuries and to be mindful at all times of your own body’s capability during the retreat. If you experience any injury or discomfort during any activity during the retreat, then you must desist immediately.
5.2. It is also your responsibility to consult a doctor to check that you are sufficiently fit and healthy to undertake yoga classes, sound baths, hikes and other physical activities that you may choose to do while on the retreat.
5.3. Please advise us of any mental or physical health conditions and dietary requirements before you book. If you have health conditions and dietary requirements that may be affected by the activities offered on our retreats we reserve the right to advise you to desist and in the interests of your well-being, or others, we may decline your stay at our retreats.
5.4. While all measures are taken to ensure a high standard of health and safety, Imiloa Institute is located in the jungle where the land is uneven and we shall not be responsible for any injuries caused by uneven terrain.
5.5. Women who are 12 to 28 weeks pregnant are advised to consult a health practitioner to confirm that they are fit to travel and able to engage in the activities that we provide.
5.6. Meals provided are all plant-based and will be prepared to the highest possible standards but food preparation carries with it inherent risks. It is your responsibility to advise the organizers of any food allergies or intolerances, at least 30 days before the arrival date. We do not accept any liability for illness caused by food consumption.
6. Cancellation by You:
6.1. You (or any member of your party) may cancel your booking at any time, provided that the cancellation is made by the person submitting the booking form and is notified to us in writing. Cancellation will take effect the day such notification is received by us. Deposits/payments are non-refundable in case of cancellation by you, unless otherwise stated on your booking confirmation. However, if another person can be found to take your place on the retreat, then we may offer you the opportunity to transfer your deposit to a future retreat or to a different person at our discretion.
6.2. Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim on your insurance.
7. Amendments by the Organizers:
7.1. Occasionally, changes may have to be made (e.x. class times, venue or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar experience.
8. Cancellation by the Organizers:
8.1. We reserve the right to cancel a retreat in case of unforeseen circumstances, in which case you will receive a full refund of any amount that has already been paid. We will always make our best efforts to avoid canceling a retreat.
9. Our Liability to You:
9.1. We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.
9.2. We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, pandemics, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.
9.3. We are not liable for any injuries you may incur. Any physical activities are undertaken at your own risk. We are not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.
10. Group Bookings:
10.1. Where a booking is made on behalf of several individuals the booking is conditional on the person(s) paying having authorization from all the individuals named on the booking form to enter into this contract. The terms of this contract will apply to each member of the group as though they had paid for their own retreat individually and directly to us.
11. No Liability for Possessions:
11.1. It is your responsibility to ensure that your possessions are kept safe at all times. This includes hired cars or other hired equipment.
12. Complaints:
12.1. If you have a problem during your retreat, please inform the organizer immediately and he/she will endeavour to put things right. Please note that we cannot be responsible for the individual behaviour of any group member or other guest sharing your accommodation.
13. Privacy Policy:
13.1. We do not share customer details with any 3rd parties. Any personal information that you provide to us will be used only for the service you requested. This information is used only for administration of the site system and in the compilation of statistics used by us to assess the use of the site. This privacy policy does not cover the links within this site linking to other sites.
14. Photography:
I, for good and valuable consideration, the receipt of which is hereby acknowledged, hereby irrevocably authorize Sleep Works Consulting to use photographs of me and or my property and authorize her and her assignees, licensees, legal representatives and transferees to use and publish (with or without my name) photographs, pictures, portraits or images in any and all forms and media and in all manners including composite images or distorted representations, and the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by the photographer or studio name here. I further waive any and all rights to review or approve any uses of the images, any written copy or finished product. I am of full legal age and have read and fully understand the terms of this release.
WAIVER AGREEMENT
I understand that my participation at the retreat requires and includes physical activities and movements. I realize that participation in these physical activities and movements provides relaxation, stress relief, sleep education and awareness. As with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will notify the instructor or facilitator, adjust my posture, participation and listen to my body. I will not push my body too far and will ask for support from the facilitator if needed.
The information and activities that I participate in are not a substitute for medical care or diagnosis. The information provided to be at The Sleep Retreat can work well in conjunction with traditional medical care. I will attend The Sleep Retreat only after discussing it with my doctor and gaining their approval. I affirm that I alone am responsible to decide whether to participate in any activity offered at The Sleep Retreat. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against Sleep Works Consulting and the Imiloa Institute.
I, hereby agree to the following:
1. That I am participating in and receiving information and instruction about yoga, breath work, sleep information, sleep education and other physical activities offered by Sleep Works Consulting. I understand that these activities may require physical exertion which may be strenuous and could cause physical injury. I am fully aware of the risks involved.
2. I understand that it is my responsibility to consult with a physician prior to and in reference to my participation in any physical activities like yoga, swimming and hiking. I warrant and represent that I am physically fit and have no medical condition that would prevent my full participation in the The Sleep Retreat activities.
3. In consideration of participating in yoga, breath work, hikes and swimming, I agree to assume full responsibility for any risks, injury or damages, which I might incur as a result in participating in these activities.
4. I knowingly and voluntarily waive any claim I might have against Sleep Works Consulting or the organizers of The Sleep Retreat for injury or damages that I may sustain as a result of participating in this program.
5. I, my heirs or legal representative forever release, waive, discharge and covenant not to sue Sleep Works Consulting or the organizers for any injury or death caused by their negligence or other acts.
I have read the above release and waiver of liability and I fully understand its contents. I fully and voluntarily agree to the above terms and conditions, as well as the Privacy Policy and Terms and Conditions of the Imiloa Institute (https://imiloainstitute.com/privacy-policy-terms/).
